These Terms & Conditions govern the use of the atecsolar.ro website and the relationship between ATEC Solar SRL and its users or clients. Please read them carefully before using the site or requesting an offer.
1. Acceptance of terms
The atecsolar.ro website is operated by ATEC Solar SRL, with its registered office in Botoșani County (full identification details are available on the Contact page). By accessing and using the site, or by submitting an offer or contact request, you confirm that you have read, understood and accept these terms together with the Privacy Policy. If you do not agree, please do not use the site.
2. ATEC Solar's services
ATEC Solar provides consultancy, design, supply, installation, commissioning and maintenance of photovoltaic systems for residential, public and industrial clients. The information presented on the site is general, informative and for presentation purposes.
3. Information, offers and prices
The technical specifications, estimates and prices published on the site or provided following a request are indicative and do not constitute a firm contractual offer within the meaning of the Civil Code. Any offer may be conditional upon an on-site assessment, is valid for the period stated within it, and prices may vary depending on equipment, exchange rate, VAT or financing programmes. Completing the offer form is a request, not a contract.
4. Formation of the contract
A contractual relationship arises solely through a written contract agreed and signed by both parties, setting out the final scope, specifications, price, timelines, warranties and payment terms. The site and any indicative offer do not, by themselves, create obligations for ATEC Solar.
5. Production and savings estimates
Any figures regarding energy production, savings, payback period or avoided CO₂ emissions are estimates based on standard assumptions (solar irradiation, orientation, consumption) and are not guaranteed. Actual results depend on weather conditions, actual consumption, the grid and usage, and ATEC Solar is not liable for any deviations.
6. Client obligations
The client undertakes to provide accurate and complete information, to hold the legal right over the property and ensure the structure is suitable for the installation, to grant the necessary access and to cooperate in obtaining the required documents. Inaccurate information may affect the offer and the execution of the works.
7. Warranties
Equipment (panels, inverters, storage systems) benefits from the warranties granted by the manufacturers, while the warranty for installation and workmanship is granted under the signed contract. Consumers benefit from the legal guarantee of conformity under Government Emergency Ordinance no. 140/2021. Detailed warranty conditions are set out in the contract and the warranty certificates.
8. Prosumer status, permits and financing
Upon request, ATEC Solar may assist the client in obtaining prosumer status, preparing the grid-connection documentation and accessing programmes such as Casa Verde Fotovoltaice. Permits, approvals and timelines depend on the network operators and competent authorities, are subject to the legislation in force and cannot be guaranteed by ATEC Solar.
9. Limitation of liability
To the extent permitted by law, ATEC Solar is not liable for indirect damages, loss of profit or damages resulting from incorrect information provided by the client, from the acts of third parties (network operators, suppliers, authorities) or from force majeure. Nothing excludes or limits liability that cannot be excluded or limited under the law, including consumer rights.
10. Intellectual property
All website content — text, logo, images, graphics and design — belongs to ATEC Solar SRL or its partners and is protected by intellectual property law. Reproduction or use without ATEC Solar's written consent is prohibited.
11. Personal data protection
Personal data submitted through the site's forms is processed in accordance with Regulation (EU) 2016/679 (GDPR), as detailed in the Privacy Policy.
12. Consumer rights and dispute resolution
Consumers benefit from the rights provided by Government Emergency Ordinance no. 34/2014, including, where applicable, the right of withdrawal within 14 days, subject to legal exceptions (for example, custom-made goods or services fully performed with the consumer's prior consent). Complaints may be addressed to the ANPC (anpc.ro), via the EU ODR platform (ec.europa.eu/consumers/odr), or through alternative dispute resolution (SAL) under Government Ordinance no. 38/2015.
13. Changes, governing law and contact
ATEC Solar may update these terms from time to time; the applicable version is the one published on the site at the time of use. These terms are governed by Romanian law, and any disputes fall under the jurisdiction of the courts at ATEC Solar's registered office, without prejudice to mandatory consumer-protection rules.
